Tariffs and Exclusion Process Proposed for Section 301 Increases

On May 28, 2024, the United States Trade Representative (USTR) published a notice in the Federal Register outlining the proposed Harmonized Tariff Schedule (HTS) subheadings that will be expecting the ad valorem tariff increases of 25%, 50%, and 100%. The USTR is proposing Section 301 tariff increases covering 382 subheadings and 5 statistical reporting numbers of the HTS as outlined in Annex A to the notice. The effective date of these increases will be August 1, 2024, and increases in 2025 and 2026 will be effective on January 1 of the corresponding year.

 

Additionally, the USTR is proposing an exclusion process for eligible subheadings of machinery classified in Chapter 84 and 85 of the HTS outlined in Annex B of the notice. These temporary exclusions to the Section 301 tariffs will be available until May 31, 2025. Further, the USTR is proposing 19 temporary exclusions for solar manufacturing equipment outlined in Annex C of the notice.

 

The USTR is seeking public comments regarding the proposed modifications and exclusion process. The public comment period will be open until June 28, 2024.
